This is a legal and binding agreement which, when signed, will limit your ability to recover from the parties indicated below for injuries or losses you sustain as a result of the activities described below.
I know that the use of Harding University recreational facilities, including but not limited to the Ganus Activities Complex, and all equipment and facilities contained therein (collectively the “Recreational Facilities”) may be hazardous and involve risk of or result in serious personal injury, death, damages, or other harm.
For and in consideration of Harding University permitting me to use the Recreational Facilities, I, my spouse, assignees, heirs, guardians, and legal representatives voluntarily indemnify, release from liability, and agree to defend and hold harmless Harding University Inc. and its officers, trustees, employees, agents, representatives, insurers, and any department, organization, or group affiliated with Harding University (collectively “Harding”) for any accident, injury, illness, death, loss, theft, damage to person or property, or other consequences suffered by me arising or resulting directly or indirectly from my use of the Recreation Facilities, including but not limited to claims arising from or related to Harding’s negligence or products liability, including strict products liability. If I am injured, I will assume any financial obligation, either through my health insurance or through other means, for any medical costs that I incur. Harding bears no responsibility for any medical expenses, injury, or damage suffered by me in connection with my use of the Recreation Facilities.
By accepting this document, I assume all risk of personal injury, death, or property damage, to the exclusion of Harding, and exempt and relieve Harding from liability for personal injury, death, or property damage.
My use of the Recreational Facilities is voluntary. I will not use any equipment, facilities, or property without first knowing and appreciating the specific dangers involved. I am responsible for safety while using the Recreational Facilities. I will follow the safety rules, obey all laws, fully utilize the safety equipment, and comply with any instructions and commands. I waive my right to bring any legal action now or in the future to recover compensation or obtain any other remedy for any injury to myself or my property or for my death, however caused, arising out of my use of the Recreational Facilities. I, my spouse, assignees, heirs, guardians, and legal representatives will not make any claim against, sue, or attach property of Harding for any loss or damage resulting from my use of the Recreational Facilities. I understand that I will be solely responsible for any loss or damage, including death, that I sustain or cause, whether in whole or in part, while using the Recreational Facilities and that by this agreement I am relieving Harding of any liability for such loss, damage, or death. I know that this is a release of liability (a waiver of my legal right to collect damages in the event of injury, death, or property damage) and a contract between Harding and me. I sign it of my own free will. I agree that this release is intended to be as broad and inclusive as the State of Arkansas will allow and that if any portion is held invalid, the rest of it will continue in full legal force.
